Terms of Service

1. Parties and Acceptance

These Terms of Service (“Terms”) govern the use of the website and related digital channels operated by Yiğit Kaan Kuştemir (Beyoğlu Tax Office, TIN: 5981171759) (“Seller”), owner and operator of the Get Society and Get SoArt brands. Anyone who accesses the site, creates an account, or places an order (“User” / “Buyer”) is deemed to accept these Terms and the related policies.

2. Definitions

• Platform: The Seller’s website and associated mobile interfaces.
• Product/Artwork: Artworks, limited editions, design objects, and bespoke productions.
• Artist: The owner of the artwork or the person/entity authorized to dispose of rights in the artwork.
• Policies: Distance Sales Agreement, Pre‑Contract Information Form, KVKK Information Notice, Cookie Policy, Refund Policy, and Secure Shopping pages.

3. Nature of Service and Marketplace Role

For certain products on the Platform, the Seller acts as the direct seller; for others, the Seller may act as an authorized intermediary/organizer. In intermediary cases, invoicing/shipping documentation and after‑sales obligations are fulfilled by the relevant Seller or Artist; this information is indicated on the product page.

4. Membership and Account Security

• Membership is restricted to individuals 18 years or older. Users are responsible for maintaining the confidentiality of account credentials and not sharing them with third parties.
• Transactions carried out via the account are deemed to be made by the User. In cases of suspected misuse, the Seller may temporarily suspend the account.

5. Ordering, Production, and Procurement

• The majority of products are made to order or prepared upon order. Production or procurement begins after order confirmation.
• The Buyer may revoke the order within 24 hours by written notice. After this period, cancellation/change requests are not accepted (see Refund Policy).
• Indicated delivery timelines may vary depending on production/procurement workload and logistics conditions. Force majeure provisions apply.

6. Pricing, Payment, and Fees

• Prices are in Turkish Lira and, unless otherwise stated, are inclusive of taxes.
• Payments are accepted via credit card, bank transfer/EFT, and payment institutions. Installments are at the discretion of the issuing bank.
• Commissions, installment charges, value dates, and processing fees applied by the bank/payment institution are subject to their terms and may be offset in refunds in accordance with applicable law.

7. Delivery, Transfer of Risk, and Courier Damage Report

• Delivery is made to the address specified by the Buyer via courier/logistics partners. Risk transfers to the Buyer upon delivery.
• An external visual check of the package should be performed at delivery; if damage/crushing/wetting is detected, a Courier Damage Report must be issued.
• Transport‑related damages discovered after delivery must be reported to the Seller in writing with photos within 48 hours.

8. Returns, Exchanges, and Withdrawal

• Artworks and personalized productions fall under the exceptions to the Right of Withdrawal for distance sales.
• There is no right of return/exchange for products whose packaging has been opened, whose seal/protective band has been removed, which have been assembled, wall‑mounted, or used.
• Only where the product differs from the listing or an authenticity issue is identified will the procedures in the Refund Policy apply.
• Revocations made within 24 hours are refunded within 14 days, net of any applicable bank/payment institution fees.

9. Intellectual and Industrial Property Rights

• All texts, images, videos, logos, designs, and artwork visuals on the Platform are protected by copyright.
• The User may not copy, reproduce, distribute, or publicly communicate Platform content without the Seller’s prior written consent.
• Artist‑owned artwork visuals may be used by the Seller in marketing activities under contractual permissions.

10. Content and Prohibited Use

• Content that is unlawful, threatening, defamatory, or infringing of IP rights may not be uploaded/submitted to the Platform.
• Any use that endangers site security, enables automated scraping, or involves reverse engineering is prohibited.

11. Privacy and KVKK

Personal data are processed in accordance with the KVKK Information Notice, Privacy Policy, and the Cookie Policy.

12. Warranty, Disclaimer, and Limitation of Liability

• Product authenticity is stated in the listing; no additional post‑delivery warranty service is provided (unless expressly stated otherwise).
• The Platform is provided “as is.” The Seller is not liable for indirect, consequential, or incidental damages such as lost profits or data loss.
• The Seller’s total liability is limited to the value of the relevant order.

13. Force Majeure

In the event of force majeure—natural disasters, fire, flood, epidemics, strikes, transportation barriers, official decisions—obligations are suspended. If the force majeure exceeds 60 days, either party may terminate by written notice. Upon termination, any amounts corresponding to used products/services and expenses are deducted, and the balance is refunded within 14 days.

14. Amendments

The Seller may amend these Terms. The updated text takes effect on the date it is published on the Platform. Continued use of the Platform after changes constitutes acceptance of the amendments.

16. Governing Law and Jurisdiction

These Terms are governed by Turkish law. In case of disputes, the Istanbul (Çağlayan) Central Courts and Enforcement Offices have jurisdiction.

17. Entire Agreement and Interpretation

• These Terms are construed together with the Policies and forms (Distance Sales, Pre‑Contract Information, Refund Policy).
• If any provision is held invalid, the remaining provisions remain in effect (severability).
• Electronic consents and records constitute conclusive evidence.
